1. Acceptance & Binding Agreement

This legally binding agreement ("Agreement") is entered into by and between PineHostBD ("Company", "we", "us", or "our") and the customer ("Client", "User", "you", or "your"). By submitting an order, creating an account, or accessing our infrastructure, you acknowledge that you have read, understood, and voluntarily agree to every provision of this Agreement. You represent and warrant that you are at least 18 years of age and possess full legal authority to enter into this contract.

2. Strict No-Refund & Payment Terms

PineHostBD enforces a strict, non-negotiable financial policy for all products and services offered through pinehostbd.com.

• All Sales Are Final: ALL PAYMENTS MADE TO PINEHOSTBD ARE 100% NON-REFUNDABLE. UNDER NO CIRCUMSTANCES SHALL ANY FULL, PARTIAL, OR PRORATED REFUND BE ISSUED FOR ANY SERVICE, HOSTING PLAN, DOMAIN REGISTRATION, OR ADDON PURCHASED.
• Forfeiture Upon Cancellation: If you elect to cancel your hosting service, domain, or account prior to the end of your prepaid billing term, you explicitly forfeit all remaining balances and prepaid time. No credit or refund will be granted.
• Disputes and Chargebacks Prohibition: Initiating a payment dispute or fraudulent chargeback with your bank, credit card carrier, or payment processor (e.g., bKash, Nagad, Rocket, PayPal, local payment gateways) constitutes a direct breach of this Agreement. In the event of a chargeback or payment dispute attempt, PineHostBD reserves the absolute right to:
  • Immediately terminate all active hosting accounts and destroy associated data without recovery.
  • Report delinquent accounts to credit reporting agencies and fraud prevention registries.
  • Assess a mandatory recovery and dispute processing fee of $50 USD (or equivalent in BDT) per disputed transaction.
• Service Upgrades & Renewals: Payments for auto-renewals, manual renewals, and upgrade fees are entirely subject to this strict No-Refund Policy.

3. Promotional Free Domain Offer (Exclusive Limited-Time Deals)

PineHostBD may from time to time offer promotional benefits, including free domain name registrations tied to designated web hosting plans. The terms controlling our promotional domain offer are as follows:

• Eligibility Requirement: To qualify for one (1) free domain name registration, the Client must purchase a qualifying package under the Limited Offer category with an upfront prepayment commitment period of three (3) consecutive years (36 billing months).
• Exclusion on Shorter Commitments: Purchases made on monthly, semi-annual, or single-year billing cycles DO NOT qualify for a free domain registration.
• Initial Term Only: The free domain offer covers the registration fee for the first initial 3-year promotional cycle only. Upon renewal at the end of the initial 3-year term, the domain name will automatically renew at PineHostBD's standard annual retail renewal rates.
• Non-Transferability & Extensions: The free domain offer applies exclusively to select domain extensions (TLDs) specified during checkout. Free domains cannot be transferred to another user, exchanged for cash, credited to an account, or applied to pre-existing domain names.
• Early Cancellation & Penalty Clause: If the associated qualifying 3-year hosting package is terminated, suspended for breach of terms, or canceled by the Client prior to the end of the 36-month term, the promotional status of the domain is immediately voided. PineHostBD will bill the Client's account for the full retail cost of the domain name registration, and the domain name shall remain locked under PineHostBD ownership until all fees are settled in full.

4. Resource Usage & Service Allocation

Every hosting account is allocated technical resources based on the specific plan purchased (e.g., NVMe SSD Storage, RAM, CPU limits, Virtual Memory, I/O rates, and Entry Processes).

• Resource Limits: You agree not to exceed the operational limits defined for your plan (such as physical memory or entry processes). Sustained resource abuse that adversely impacts other tenants on shared servers will result in automated throttling or temporary suspension.
• Unmetered Bandwidth: Where bandwidth is listed as "Unmetered", it is intended for normal web host usage. Unmetered bandwidth does not permit the execution of file-sharing mirrors, public cloud storage services, mass streaming distributions, or file-dumping operations.

5. Acceptable Use Policy (AUP) & Prohibited Content

PineHostBD maintains zero tolerance for server abuse, illegal activities, or malicious hosting behaviors. You explicitly agree NOT to store, host, link to, or transmit any of the following items:

• Copyright-infringing material, pirated software, cracked applications, or unauthorized torrent trackers.
• Malware, ransomware, trojans, phishing scripts, botnet control software, or network scanning tools.
• Unsolicited Bulk Email (Spam), mail-bombing scripts, or unauthorized mass mailing operations.
• Content related to fraud, illegal gambling, financial scams, or deceptive schemes.
• DDoS attack launchpads, IP spoofing mechanisms, or open proxies.

PineHostBD retains sole discretion to determine what constitutes a violation of our Acceptable Use Policy. Accounts violating this section are subject to immediate, permanent termination without prior notice and without refund eligibility.

6. Backups, Data Integrity, and Loss Prevention

YOU EXPRESSLY ACKNOWLEDGE THAT ALL DATA BACKUPS ARE THE SOLE RESPONSIBILITY OF THE CLIENT.

• While PineHostBD may perform automated maintenance or system-level snapshots, PineHostBD DOES NOT guarantee the availability, integrity, or completeness of client backups.
• Clients are strictly advised to download and store independent off-site backups of all website files, databases, configurations, and email accounts.
• PineHostBD shall not be held liable under any circumstances for lost files, corrupted databases, missing emails, or hardware failures resulting in data loss.

7. Service Availability & Uptime Disclaimer

PineHostBD makes reasonable commercial efforts to ensure optimal server uptime and connectivity. However, PineHostBD does not guarantee uninterrupted, error-free operations. Service outages caused by scheduled hardware maintenance, upstream provider disruptions, emergency security patches, network attacks (DDoS), or acts of God shall not constitute a breach of this contract.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PINEHOSTBD, ITS DIRECTORS, EMPLOYEES, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, PUNITIVE, OR EXEMPLARY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF BUSINESS PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, LOSS OF DATA, OR ANY OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF OR INABILITY TO USE OUR SERVICES.

IN ALL CASES, THE TOTAL AGGREGATE LIABILITY OF PINEHOSTBD TO YOU FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THE USE OF OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT ACTUALLY PAID BY YOU TO PINEHOSTBD IN THE ONE (1) MONTH IMMEDIATELY PRECEDING THE INCIDENT GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend, indemnify, hold harmless, and release PineHostBD, its owners, operators, and agents from any and all claims, damages, liabilities, costs, losses, or legal expenses (including reasonable legal fees) stemming directly or indirectly from your account usage, content hosted on your account, breach of these terms, or violation of third-party intellectual property rights.

10. Right to Termination & Suspension

PineHostBD reserves the absolute right to modify, suspend, restrict, or terminate any account or service at any time, with or without cause, and with or without notice. In instances of service suspension due to abuse, illegal activities, non-payment, or chargeback threats, PineHostBD is under no obligation to provide website archives, backup access, or database exports.

11. Amendments & Terms Updates

PineHostBD reserves the unilateral right to revise, modify, or rewrite any portion of these Terms and Conditions at its sole discretion without prior direct notice to Clients. Revised versions become effective immediately upon being published to pinehostbd.com. Continued use of our infrastructure or billing services after amendments are posted constitutes full acceptance of the updated terms.

12. Governing Law and Severability

This Agreement shall be governed by, interpreted, and enforced in accordance with applicable local laws. If any provision of this Agreement is declared invalid, unlawful, or unenforceable by a court of competent jurisdiction, that specific provision shall be severed, and the remaining provisions shall continue in full force and effect.
